However, each branch also shares these functions with the other branches.

2. CHECKS AND BALANCES. Different agencies or branches of government have adequate power to check the powers of other branches. Checks and balances may include the power of judicial reviewÀ"Àthe power of courts to declare actions of other branches of government to be contrary to the constitution and therefore null and void.

3. DUE PROCESS OF LAW. Individual rights to life, liberty, and property are protected by the guarantee of due process of law.

4. LEADERSHIP SUCCESSION THROUGH ELECTIONS. Elections insure that key positions in government will be contested at periodic intervals and that the transfer of governmental authority is accomplished in a peaceful and orderly process.

Lincoln wasn't entirely accurate. He did not organize the government of the United States either.

Each State has a constitution that is put together by the people. That document is what creates the State in the first place. It defines and authorizes the State government certain powers.
Each State is the owner of the federal constitution. They wrote it. They give the federal government certain powers through that document. This is what is meant by Lincoln's remarks.

We are not a democracy. We are a federated republic.

How do North Dakota Native Americans not qualify to vote?

Can we drop the "North Dakota native" crap and just ask "How do Americans not qualify to vote? Then look at the laws and answer that question for yourself. Try to walk onto a reservation and vote in a tribal election without being able to identify yourself as a member of the tribe. EVERY AMERICAN SHOULD HAVE TO IDENTIFY THEMSELVES TO VOTE! EVERYONE!
